This-will acknowledge receipt of your letter dated September 29, 1989 and your
~ check for $25,000'in payment for the civil penalties proposed by NRC in a letter
,>p-dated. August 31, 1969. We note your exception to the NRC statement that you W'"
determined that'the sole root cause of the violation was the individual licensed operator error and that NRC intervention was necessary to focus your attention on the program weaknesses. The basis for this statement was our observation and conversations with your middle management which lead us to initially believe that you were fosusing too much attention to the individual licensed operator.
The NRC acknowleds,es ti.at once this matter was brought to the attention of senior management the root cause was properly determined to be more than individual error. Ycur corrective actions will be examined during future inspections.
