Dear Members of the Board:

As reported in the letters to the Board dated June 7,1979, and November 5,1979, from Applicant's counsel, technical and legal representatives of the Applicant, Suffolk County and the NRC Staff are engaaed in a continuing series of negotiations to resolve or particularize the County's contentions.

Enclosed is the third stipulation dated June 10, 1980, which has resulted from these negotiations.

The parties request that this stipulation be accepted by the Board.

The NRC Staff, however, notes that it does not interpret footnote 2 to the Stipulation to allow the reformulation or addition of contentions except insofar as they may ordinarily be proper under the rules and precedents of the Commission. See also Policy Statement of Interim Policy - Nuclear Power Plant Accident Con-siderations Under the National Environmental Policy Act of 1969, a copy of which has previously been served on the Board and parties.
