This refers to your letter dated Mar.ch 28, 1980, with attachment, in which you deny two items of noncompliance contained in our letter dated March 10, 1980, Appendix A, Notice of Violation, but, in addition, provide statements of correc-tive and preventive actions. These items were also discussed in a telephone conversation between Mr. Mathews, of your staff, and Mr. Brown, of this office, on March 26, 1980.

With regard to item A.1, our inspector observed that the double stacked drums were not completely and solidly packed in the trailer so as to prevent shifting.

The enclosed copies of our photographs (Figures 1 and 2) show a large void between the last row of unbraced drums and the rear doors of the trailer. If the drum load had shifted through the void into contact with the rear doors, the top drums may have fallen out and the closure broken open when the doors were opened. Accepted practice under 49 CFR 173.393(c)(6) for similar drum loads has involved bracing to " prevent...a shift of lading under conditions normally incident to transportation." Our notes on this shipment correspondingly Mentify the trailer (number 003) appearing in the Figure 2 photograph as contairang the drums in question.

Therefore, Item A.1 remains an item of noncompliance as previously discussed.

With regard to Item 2. A, our inspector could not see the " Radioactive - LSA" markings which you say appeared on the drum lids due to inaccessibility at the time. A requirement to perform inspections of other incoming trucks prevented further verification. For these reasons, we will accept your statement that the lids of the drums were properly marked and therefore, this item of noncompliance is withdrawn as previously discussed.

We appreciate your informing us of your corrective and preventive actions to assure compliance with these regulations concerning shipment of radioactive materials. We will examine your corrective actions and plans during subsequent inspections.
