Chairman Nuclear Regulatory Commission 1717 H Street NW Washington, D.C. 20555 April 21, 1980 RE: Conflicts of Interest Relating to the preparation of an Environmental Impact Statement for proposed Westinghouse nuclear fuel fabrication facility by employees of Union-Carbide Docket No. 70-2909

Dear Sir:

As you know, Westinghouse Electric Corporation proposes to build a nuclear fuel fabrication facility in Prattville, Alabama.

Westinghouse has, of course, applied for a license to utilize special nuclear material.

The Commission, therefore, must prepare an Environmental Impact Statement pursuant to its licensing procedure.

On March 27, 1980, at a scoping hearing held in Prattville, Alabama, the announcement was made that the Commission had entered a contract with Oak Ridge Laboratory to prepare the EIS.

Discussions with the persons introduced as the people who would actually prepare the EIS revealed that they were actually employees of Union-Carbide.

Of course Union-Carbide is extensively engaged in mining uranium and in the low enrichment process. The proposed facility in Prattville would use UF6 prepared by Union-Carbide.

Title 42, United States Code, Section 2210(a) provides that the Commission "shall, by rule, require any person proposing to enter a contract, agreement, or other arrangement....for the conduct of research, development, evaluation activities or for other technical...

services to provide the Commission...with all relevant information" bearing on conflicts of interest.

Certainly the contract providing for Union-Carbide employees to prepare an EIS for a facility which would constitute a large market for Union-Carbide falls within this section.
