APPENDIX A NOTICE OF VIOLATION Teledyne Isotopes, Incorporated Docket No.70-124 Based on the results of an NRC inspection conducted on February 14-15,1980, it i

appears that certain cf your activities were not conducted in full compliance with NRC regulations ans the conditions of your NRC facility license as indi-cated below.

Item A is an infraction.

Items B through D are deficiencies.

A.

10 CFR 21.21(a) " Notification of failure to comply or existence of a defect" requires that, "Each individual, corporation, partnership or other entity subject to the regulations in this part shall adopt appropriate procedures...".

10 CFR 21.6 " Posting Requirements" states, in part, that each corporation subject to the regulations in this part shall post current copies of (1) the regulations in this part, (2) Section 206 of the Energy Reorganization Act of 1974, and (3) procedures adopted pursuant to the regulations in this part in a conspicuous position on any premises.

Contrary to the above, as of February 15, 1980, the appropriate procedures had not been written and adopted and the required documents and/or notice had not been posted in the facility pursuant to the regulations in this part.

B.

Condition 8 of your facility license incorporates your approved license application dated November 18, 1968 which requires, in part, in the general procedure " Waste Disposal" included in Attachment C, that "When material is added to the waste drum, make a notation of the isotope, estimated amount and date on the form attached to the drum."

Contrary to the above, on February 14, 1980, the required forms were not attached to or available for three of four radioactive waste drums located in the Sample Preparation Laboratory. Thus, no record of the information specified on the form was maintained for these waste drums.

C.

10 CFR 20.203(f) states, "(1) Except as provided in Paragraph (f)(3) of this section, each container of licensed material shall bear a durable clearly visible label identifying the radioactive contents.

(2) A label required pursuant to Paragraph (f)(1) of this section shall bear the radiation caution symbol and the words ' CAUTION, RADI0 ACTIVE MATERIAL' or ' DANGER RADI0 ACTIVE MATERIAL.'

It shall also provide suf-ficient infonnation to permit individuals handling or using the containers, or working in the vicinity thereof, to take precautions to avoid or mini-mize exposures."

Contrary to the above, on February 14, 1980, two waste drums located in the Sample Preparatica Laboratory containing in excess of 0.01 microcuries of Uranium-235 were not labeled with Caution - Radioactive Material signs.

10 CFR 70.54 " Nuclear M'terial Transfer Reports" requires that each licen-D.

a see who transfers and each licensee who receives special nuclear material shall complete and distribute a Nuclear Material Transaction Report of Form NRC-741, in accordance with printed instructions for completing the form, whenever he transfers or receives ~a quantity of special nuclear material of 1 gram or more of contained Uranium-235, Uranium-233, or plutonium.

Contrary to the above, during 1978, NRC-741 forms for shipment ZKD-KAS-3 did not show type of package used and shipment ZKD-VBM-14 did not identify the licensee's license number.
