Dear Mr. Giambusso:

On December 21, 1973, Duke Power Company responded to your letter of October 9, 1973 and stated when B&W and the AEC regulatory staff have reached agreement on additional analyses necessary to satisfy the ATWS criterion, these analyses would be subritted for review.

Babcock & Wilcox has informed Duke Power Company that additional time is necessary to ensure the methods used for ATWS events analyses are reasonably predicting transient consequences. Therefore, we regret that we will not be able to respond to ATWS by October 1, 1974.

The B&W topical report to address ATWS and WASH-1270, " Anticipated Tunsients Without Scram for Water-Cooled Power Reactors," is expected to be submitted on December 13, 1974. Our response to ATWS will be transmitted as soon as possible following review of the B&W topical report.

Very truly yours, A. C. Thies i
