Based on the results of an NRC inspection conducted on May 15, 1980, it appears that one of your activities was not conducted in full compliance with NRC regulations as indicated below. This item is categorized as severity level 3.
10 CFR 71.5, " Transportation of licensed material states "no licensee shall transport any licensed material outside of the confines of his plant or other place of use, or deliver any licensed material to a carrier for transport, unless the licensee complies with the applicableof requirements of the regulations appropriate to the mode of transport, the Department of Transportation in 49 CFR Parts 170-189..."
49 CFR 173.392(c)(1) states, in part, that LSA material shipped in sole use vehicles must be packaged in strong, tight packages.
Contrary to the above, on May 15, 1980, at the Richland, Washington, burial site a package of LSA material off loaded from a sole use vehicle was observed with a 4 inch gash on a side. This material had been shipped by your Defense System Division.
