Dear Mr. Attorney General:
Under cover letter dated July 1,1980, Duke Power Company (" Duke") filed an
" Application for Amendment of Construction Permit No. CPPR-ll6 Adding Co-Owners and Co-Applicarts."
This amendment seeks to add as co-owners and co-applicants the North Carolina Electric Membership Corporation (NCEMC) and the Saluda River Electric Co-operative (Saluda River) to the Catawba Nuclear Station Unit 1.
The owner-ship shares in the Catawba Unit 1 and the support facilities are 56.25" and 28.125". for NCEMC and 18.75". and 9.375". for Saluda River.
The most recent antitrust review of this matter was in connection with an application for an amendment to add as a co-owner the North Carolina Municipal Power Agency Number 1 to the Catawba Nuclear Station Unit 2.
Your advice letter in connection with that application is dated August 25, 1978.
We are transmitting herewith one copy of the information requested by the Attorney General for the antitrust review which has been accepted for the pur-pose of initiating the review.
THe material is being transmitted to afford you an opportunity to render such advice to the Commission as you determine to be appropriate in regard to the findings to be made by the Comniission pursuant to Section 105(c)(5) of the Atomic Energy Act of 1954, as amended.
The Duke Power Company has requested that we give this matter expedited considera-tion.
