NRC STAFF COMMENTS ON AFFIDAVIT DATED MAY 21, 19_80 0F DAVID SPRINGER On April 15, 1980, David Springer filed, for a second time, a late petition to intervene, again urging Lake Norman with once-through cooling as a more appropriate site for the proposed Perkins facility. Mr. Spri e r has pre-viously unsuccessfully advanced Lake Norman as the best site in this pro-ceeding. On May 5, 1980, the NRC Staff filed a response to Mr. Springer's April 15, 1980 petition opposing the petition. Mr. Spr. 'er then filed an

" affidavit" on May 21, 1980, supporting his petition.

In an Order dated June 17, 1980, the Licensing Board requested NRC Staff comments on the May 21, 1980 affidavit. This filing constitutes our coments.

The affidavit dated May 21, 1980 does little more than reiterate the contents of Mr. Springer's petition dated April 15, 1980. We believe the arguments set forth in the Staff's May 5, 1980 "NRC Staff Response to Petition Dated April 15, 1980 Filed by David Springer" adequately responds to the contents of Mr. Springer's affidavit.
