I MR. CHILK:
The Cc.amission has before it a memorandum 8
and order in the matter of Edlow International Company, an agent 9
for the Government of India, on applications for export of 10 special nuclear materials and components.
11 The Commission, by a unanimous vote cannot find, based 12 on a reasonable judgment of the assurances provided by the 13 Government India and other information available, that license 14 applications identified as XSNM01379 and 1569, XCOMO240, 0250, 15 0376, 0381 and 0395 meet the criteria for issuance set forth 16 in Sections 109, 127, and 128 of the Atomic Energy Act.
17 Accordingly, NRC is referring these applications to the President pursuant to the procedures set forth in Section 18 19 126 (b) (2) of the Atomic Energy Act.
Mr. Kennedy, who is not present today, joins in the 20 unanim us vote of the Commission.
The order will also have 21 attached to it the separate views of Chairman Ahearne, 22 Commissioner Gilinsky, Commissioner Kennedy, Commissioner Hendrie, 23 with Commissioner Bradford basically agreeing with Commissioner Gilinsky's comments.
