Docket No. 50-312 Guard Response to Threats
Dear Mr. Boyd:
The District is responding to your request on the subject of guard responsibilities in protecting special nuclear material from thef t and sabo-tage, at Rancho Seco Nuclear Generating Station.
First of all, I would like to point out that in our opinion, Rancho Seco Nuclear Generating Station does not come under 10 CFR 73.50 (g) (2), as we are licensed under Part 50 of 10 CFR and thus are specifically exempted, as stated in the introductory paragraph of 8 73.50.
However, we have reviewed both the current Rancho Seco Security Plan and our recently submitted new Security Plans, and it is our opinion that both plans meet fully the intent of 8 73.50 (g) (2).
Both Security Plans direct that the guards will respond to any evidence of intrusion, sabotage or threat, and will assess the extent of the threat and convey to local law en forcemen t, as well as District Management, the extent of the threat.

guards have authority to take independent action, as needed, pending arrival of higher authority. The District does not forbid the use of force in general or deadly force, however, we

the laws governing the use of force.
