Reference is made to your letter of November 13, 1972. A copy of our letter of September 1, 1972 to Mr.
John F. O' Leary was not sent to you for several reasons.
First of all, the concern expressed in your Conditional Request for Hearing appeared to be fully resolved between i
the Justice Department, the AEC Staff and Florida Power.
Secondly, your Conditional Request for Hearing was untimely by about twenty days, and the AEC has not yet ruled whether

or not Gainesville has become a party.
The precise language of two explanatory notes to our previously agreed to conditions remains to be re-solved by Florida Power Corporation, Justice Department l
and the AEC Staff. Neither of them involve the subject matter expressed in Gainesv111e's Request for Hearing.
l Therefore, we do not agree with you that "Gainesville's participation as a full pasty to these proceedings appears j
imper-*ive if its concerns are to be protected."
