This is in reply to your request dated June i, 1 7C, for an exe:ption from the pr0Vicions of Cectico 50.10(b), 10 CIR Part 50 of the Ocm:miasica's rules pureusot to Section 50.12 cf the ruiss to pemit the perfor:sance of certain verk at the site of the " avis-Nase Muclear Pcver Statica prior to the issuance of a :castruction permit by the Cedasion.

The Toledo Edison Company SEP 101970 concluded that the granting of the proposed exemption is authorized by law, will not endanger life or property or the conncu defense and security, and is othervice in the public interest.
Accordingly, the Ccasaission hereby authorizes you to construct those portions of the reactor facilities heretofore mentioned and described and requested in your 1stter dated June 4, 1970, prior to the issuance of a construction pe nit.
I vish to empbezize that the granting of this exemptica shall have no bearing upon the subsequent granting or denial of a ecnatruction permit for the proposed Davis-3esas Nuclear Power Station, any verk perfarned pursuant to this exemption shall be performed entirely at the risk of 3e Toledo 311 son Courpany et al.
Furthermore, the granting of this exemption does not constitute nn approval of tha type er adequacy of the nethod of its installation.
