Dear Judge llennett:
This is the responce to Mr. David A. Leckie's letter of April 26, 1973, a copy of which was sent to you and other members of the Atomic Safety and Licensing Board'. The Board's Order dated January 8,1973, regarding subpoenas duces tecum innued at the requect of the Department of Justice, reduced to ten years period of inquiry and required the Department to ncnd each of the the rec i pi e n t :. a let t er upocifying, "in case of internal documenta the nature and dinI rlhutJon of the same, and in case of external comiminicat innn t he i.<rson to whom nent or from whom received." On January 24, 1973, the Board issued a further Order (copics of which were not t. ben made availabic to this Company or other recipients of the Department. of Justice subpoena) in which the Board treated the Department 'of Juntic6 's letter of January 15, 1973, advising the Board of difficultics in necking to cpecify the nature and distribution of exact documents sought, an a motion for reconsideration and allowed the Department of Justice to aupport ita motion by' affidavit. The Department of Justice's affidavit was fi1ed on February 8, 1973. in the lloard's most recent order, Prehearing Order No. Six, dated March 22, - 10 T), Ila linard stated that it was inclined to modify the conditionn that.the Order .:peciiied in the Order of January 8, 1973, "to the extenL 7912190 N M. /'1 ~

The Department of Justice's letter further defined the-term "Picdmont Carolinas" as "the geographic arca generally coextensivu with _ the transmission system of Duke Power Company." As-provided in the' Order' of March 22, 1973, the company was allowed to . renpond to Department of Justice af fidavit' of February 8,1973. This response wan' fildd under cover of the Company's letter of April 9,1973. In this renpoi..;c the Company reemphasized that in the interest of fairness, justice time and reluvancy it should not be required to undertake the expennive, connuming,and burdensome investigation of the general nature described in the nubpoena duces tecum unicas the nature of the documents sought were specifically identified in the manner required by the Board's Order of January 8, 1973.
