In response to the Board's Provisional Order Following Special Prehearing Conference, NIPSCO submits the enclosed statement of objections.

It appears from the Provisional Order that the Board expeccs to receive reworded proposed contentions produced as a matter of meetings held among several petitioners for I

Herbert Grossman, Esquire Mr. Glenn O. Bright Mr. Richard F. Cole June 30, 1980 Fage Two leave to intervene, the NRC Staff, and NIPSCO. (Provisional Order, pp. 30, 49-50). We therefore wish to advise the Board that representatives of the NRC Staff, the State of Illinois, Porter County Chapter Petitioners, and NIPSCO met twice since the Special Prehearing Conference to dicusss rewording of contentions proposed by PCC Petitioners and by Illinois. These meetings did not result in agreement.

After receipt of the Board's Provisional Order, the parti-cipants consulted with a view toward scheduling additional meetings. These efforts were not successful.

NIPSCO concludes that it is not possible for the parti-cipants to reach agreement on reworded contentions on a timely basis. We therefore request that the Board rule on the admissibility of contentions as previously filed by petitioners. It is cur understanding that PCC Petitioners and the State of Illinois plan to file additional statements of the contentions earlier sought to be incorporated by reference. NIPSCO will promptly respond to such filings.
