I write concerning the NRC's consideration of the g
renewal of the Bailly nuclear power plant construction j
permit.
I am very disturbed by the enclosed NRC brief of j
April 10 in which the staff concludes,
...the inter-i relationship between ash pond seepage and construction dewatering, and their collective environmental impacts on the lakeshore and environs, was fully and finally decided during the Bailly construction permit hearings and i
is not a proper subject for relitigation in this matter."

As the enclosed study by the Lake Michigan Federation suggests, serious uncertainties continue to cloud these l
issues, and new conditions have arisen since the pt mrious litigation.
Under these circumstances, I fail to see how the NRC c'an view the issue as " fully and finally decided."

I certainly believe that this decision should be reconsidered.

NRC STAFF ERIEF ON THE FINALITY OF ASH POND SEEPAGE AND CONSTRUCTION DEWATERING CONSIDERATIONS AT THE BAILLY CONSTRUCTION PERMIT STAGE At the'Special Prehearing Conference held in the captioned proceeding on March 12-13, 1980, the Licensing Board Chairman requested the participants

to brief the question of whether the relationship between ash pond seepage from the coal plants adjacent to the Bailly site and the effects of construc-tion site dewatering can be considered in this proceeding in light of the litigation of this matter in the Bailly construction permit hearings (Tr.
227).
The Chairman's briefing request was prompted by the submission of substantially identical propose.d contentions regarding site dewatering by intervention petitioners Porter County Chapter of the Izaak Walton League, et al. and the State of Illinois.

I am employed by the U. S. Nuclear Regulatory Commission as a Senior S
Environmental Project Manager, in the Division of Site Safety and En-vironmental Analysis, Office of Nuclear React'ar Regulation.
2.
I am the enviromental project manager assigned to the Bailly Generating Station construction permit extension application.
3.
I was the environmental project manager responsible for the final direc-tion and supervision of the environmental review of the Bailly construc-tion permit application.
This review culminated in the issuance of an NRC Staff Final Environmental Statement, dated February,1973, and sub-sequent submission of direct testimony at evidentiary hearings held before an Atomic Safety and og 7
