Dear Senator Sarbanes:

This letter is in response to your request for a reply to Mr. Obler's letter concerned with the return of Three Mile Island Unit No.1 (TMI-1) to operation.

We at the Comission understand the concerns with respect to the financial burden of General Public Utilities which could be partially relieved if TMI-l could resume operation. However, the Nuclear Regulatory Comission is by law limited to the regulation of the safety of nuclear reactors.

On July 2,1979, the Comission ordered that TMI-l remain in a cold shutdown condition until further order by the Comission itself and stated that a public hea. jag would be held prior to restart of THI-1. The Comission believes that sublic participation.is a vital ingredient dealing with those matters related to the TMI-l restart.

On August 9,1979, the Comission issued an additional Order on TMI-1 specifying the basis for the Shutdown Order and the procedures to gcvern the hearing regard-ing any TMI-1 restart. On the basis of this hearing, the Comission will determine whether any further operation of TMI-l will be permitted and, if so, under what conditions.

I have enclosed a copy of the August 9,1979, Order for your information.

The Comission's Order also identifies a number of items that nust be resolved prior to restart. These items, which are listed on pages 5-7 of the Order, include but go beyond that required for restart of other Babcock & Wilcox design pres-surized water reactors similar to TMI-l and 2.

Included in these additional items are items recocinended by the Lessons Learned Task Force, which studied the TMI

' accident.

The Comission carefully considered the time required for ccgleting all tasks related to the Order on TMI-1 and which must be cowleted prior to any restart of TMI-1. A Comission schedule calling for expeditious handling of the necessary L

NRC staff actions and procedural actions required for the hearing process is pro-p vided on the last page of the Comission's Order. Preparations for the hearing have required more than the Comission's guidelines anticipated. Our current h

best estimate for the hearing to conenence is October 1980.
