bv RTE-Delta Corporation Docket No. 99900703/80-01 NOTICE OF VIOLATION Based on the results of an NRC inspection conducted on February 19-21, 1980, it appears that certain of your activities were not conducted in accordance with NRC requirements as indicated below:
Paragraph 21.21 of 10 CFR Part 21 states in part, "Each individual, corpora-tion, partnership or other entity subject to the regulations in this part shall adopt appropriate procedures to (1) provide for (i) evaluating devia-tions or (ii) informing the licensee or purchaser of the deviation in order that the licensee or purchaser may cause the deviation to be evaluated unless the deviation has been corrected; and (2) assure that a director or respon-sible officer is informed if the construction or operation of a facility, or activity, or a basic component supplied for such facility or activity:
(i) Fails to comply....or (ii) Contains a defect."
Paragraph 9.0 of Appendix B, Revision B, dated January 14, 1980, of De Laval Engine and Compressor Division Purchase Order No. 59008, states in part,
" COMPLIANCE WITH 10 CFR 21.
The Seller is subject to the provisions of Part 21, Chapter 1 of Title 10 of the Code of Federal Regulations." Note:
This requirement is located en sheet 22 which is identified as Revision C, dated January 24, 1980 of Appendix B.
The NRC inspector observed that a recently completed (hardware shipped January 1980) Bechtel Power Corporation Purchase Order (P.O.) No. 9645-E-021.0, dated October 3, 1974, had also imposed 10 CFR 21.
P.O. Revision 16, dated February 7, 1978 imposed 10 CFR 21.
Contrary to the above, procedures had not been adopted to evaluate deviations or inform the licensee or purchaser of such deviations as required by De Laval Engine and Compressor Division Purchase Order No. 59008.
