Cocket No. 50-320 Gentlemen:

Immediately subsequent to the hearings on the aircraft crash probability issue, I initiated efforts to obtain further information concerning US Air flight No.170 regarding which Intervenors' witness, Dr. Johnsrud, testified.

Although the desired information has been slower than anticipated in coming, I recently received the attached letter (undated) from the First Officer of that flight. His letter is in reply to my letter to him dated April 29, 1980, a copy of which is also attached.

I have not as yet received any reply from the Pilot of the aircraft, although I am continuing to pursue the matter with him.

Please note that I am informed that this flight was commanded by a two-person flight crew, a pilot and first officer.

Until a reply is received from the Pilot, the Staff does not believe it appropriate to either characterize the effect that the substance of the First Officer's letter may have on Dr. JMsrud's testimony, or to offer this letter in evidence. Rather, it is being provided at this time solely for the purpose of notifying the Appeal Board and parties of my efforts and providing the results thereof, however limited, for everyone's information. Upon receipt, the pilot's response to my letter will similarly be provided to the Appeal Board and parties. At that time, I will also provide the Staff's suggestion for treatment of both letters vis-a-vis the record in this proceeding, e.g.,

a motion to open the record for receipt of Staff exhibits, if appropriate.
