Dear Ms. O' Brian:
Your letter of February 26, 1980 to President Carter has just recently been referred to me for reply.
In your letter, you indicated concern regarding the Nuclear Regulatory Comissicn (NRC) recommendations to start issuing licenses to build nuclear power plants and specifically those designed by the Babcock & Wilcox Company (B&W), in lieu of the recent Crystal River, Unit No. 3 incident. As you indicate, this plant was designed by B&W; the same company which designed the Three Mile Island (TMI-2) plant.
First, I believe that it would be useful to you if I explained our licensing process.
Prior to a proposed plant being built it must receive a construction permit.
This process is initiated by an applicant making application to the NRC and providing certain documentation to include a Preliminary Safety Analysis Report (PSAR).
The PSAR sets forth the preliminary information of the proposed design of the facility and a detailed review of the information is made by the staff. At the conclusion of our review, a Safety Evaluation Report (SER) is issued by the staff stating our findings.
In addition to our review, the Advisory Comittee on Reactor Safeguards (ACRS), an independent statutory comittee established to provide advice to the NRC on reactor safety, makes an independent evaluation and presents its advice to the Commission. Addition-ally, a public hearing is held by an Atomic Safety and Licensing Board.
Only after each of these steps have been satisfactorily completed can a construction permit be issued.
The NRC is in the final stages of development of an Action Plan for the Comission's review and approval.
This Action Plan will implement recommen-dations of the President's Commission and other studies resulting frcm TMI-2 to inch;de the Lessons Learned.
The Action Plan will include new or improved safety objectives, the detailed criteria for their implementation and the I
various implementation deadlines. Any new safety requirements arising from i
the approved Action Plan will have to be evaluated to determine whether they l
are applicable to each plant (B&W design as well as other designs) and will j
be applied accordingly.
The SER will reflect our evaluation of these matters.

O'Brien 24 590 With respect to the Crystal River incident, I am enclosing a letter that was sent to B&W operating reactors in which a description of the sequence of events for the incident is given together with the planned corrective actions (o the Crystal River plant being taken by the Florida Power Corp-oration. Rest assure that the NRC in its review of a proposed nuclear plant will incorporate any " Lessons Learned" from the Crystal River incident.
