Your letter of March 3,1976, has been referred to this office for reply.
In your letter, you state that you had nodified the design of the Diesel-Generator Fuel Oil Storage Systen for Davis-Eease, Unit 1 and that the new seismic Category 1 design is expected to he operational hy June 1977.
2ased on our review, we find that it vould be accontahle to allov temporary operation of Davis-Besse, Unit I with the Diesel-Generator Fuel Oil Storage System (JGFOSS) which is precently scheduled for completion prior to the fuel loading date. We
?lan to limit operation of Davis--? case, Unit I with this svsta=
to.'ane 14, 1977, beyond which operation with the codified desi;;n vill be rc<;uired. We plan to condition the cperating license to this effect.
Tae basis for this determination is that the likelihood of an accident occurring within the tir.c period under consideration, that requires the new seismic Category I OGFCSC in acceptably ranote.
A copy of this letter is keing sent to our Of fice of Inspection and inforcenent. They vil'. be responsible for inspection of the revised DCyOSS to see that the design and connruction confor=9 to the co rit.'ents made in Revision 17 of the Javis-Ecsse, Unit 1 "SAR.
