FROM:
Joseph J. Fouchard, Assistant Director, OPA I have inquired into the circumstances which led to your not receiving the public announcement on the proposed Duke Power Company civil penalty until mid-afternoon on the day it was issued (March 31).
Here is the story.
The Comission was informed of the planned civil penalty action, including the schedule, by I&E on March 24 (EN-77-05). We had planned to circulate the announcement to the Comission on Tuesday, March 29, but we received word that a " hold" had been pla..?d on the action. We were advised on Wednesday, March 30, that the " hold" had been removed and that the company i
had been infomed of the action and the letter from Dr. Volgenau has been transmitted by facsimile to the company.
j In view of the press and public interest in the recent release of radio-l active materials from Oconee and the likelihood that the company would l
1ssue a statement on the proposed civil penalty promptly, we decided to.:
l move forward with the press release on schedule March 31. The memorandum to the Commission was signed late afternoon March 30, but missed the last T*
mail from Bethesda.
It should have gone on the first mail at 8 a.m.
l March 31, but obviously it did not since it was received in the Secretariat i
at 11 a.m.

We should have followed through on the memorandum and will do so in the future.
