For reasons set forth in the February 8, 1973, Affidavit of Wallace Edward Brand, our letter of January 15, 1973, to the Chairman of the Board, and our December 20, .

1972 Answer to motion of VEPCO and two other companies, the Department opposes VEPCO's motion.

While not agreeing that-the subpoena places a substantial burden on VEPCO, we are prepared to discuss with the company a proposed method of reasonable and practical compliance that would minimize any such burden. We have received agreement on a similar method of compliance with South Carolina Electric

& Gas Company, thereby precluding the need for a Board ruling on the motion ~ to quash the subpoena directed to that company.

Thus far we have been unable to present our proposal to VEPCO because of the absence of its counsel, Mr. John H.

Shenefield. We therefore request the Board to defer ruling on VEPCO's motion and this answer until May 4, 1973, so as to allow sufficient time for discussions with VEPCO and determination whether any objections to the subpoena remain.
