Dear Judge Bennett:

Shortly after the filing of our motion for further extension of time for response to Applicants inte ogatories, dated 21 November 1973, counsel for Applicant informec us that Applicant had no objection to the granting of the motion, on the following understanding:

(1) that Intervenors intended to furnish the responses as soon as each item was prepared, and (2) that if as a result of the extension prayed for Applicant finds that its depositions of Intervenor and EPIC witnesses cannot be completed by 14 December 1973, Intervenors will support a request for the necessary extension or. that ground.

Intervenors undertook to meet the first of these conditions in the 21 November motion itself, and they hereby agree to the second.

Sincerely yours, I Ylbef  : W
