i Pursuant to paragraph B. 3 (b) of Prehearing Order Number Six, issued in the above-captioned proceeding, a Statement was filed on behalf of Applicant on May 16, 1973, setting forth those documents subpoenaed from EPIC, Inc., which then had not been provided.
The deficient subpoenaed items were set forth in Appendix A of that Statement.
Item 11 called

Each document prepared by or for EPIC, or any of its employees, agents or consultants, which re-l lates to, ccmments on, evaluates or discusses i
the siting criteria established by the Atomic Energy. Commission or how EPIC.or North Carolina Consumers Power would comply'with such criteria.
In a meeting.with William T.
Crisp, counsel for EPIC, i
Inc., held at the offices of Wald, Harkrader & Ross on June 23, 1973, Mr. Crisp advised me~ that documents-responsive to item 11 7912180 %
. ~.a
were being withheld on the ground that information regarding future sites was a " trade secret".
I subsequently advised Mr. Crisp by telephone and by letter (dated August 16, 1973) that Applicant would agree to the deletion from the said documents of specific identi-fication of the future sites involved.
I further suggested that this would balance the interests of all concerned.
Having had no response from Mr. Crisp, I telephoned
]
him on September 5, 1973, and was told by him at that time i
that he had instructed EPIC's consultant to provide the in-formation requested with the references to identifiable future sites deleted.
Mr. Crisp also stated that I probably would receive these documents in a matter of days.
To date, I have i
not received the said material.
