PRdHEARING ORDER NUIGER FOUR The Board has considered the issues to be tried in the above entitled proceeding and has also considered additional special rules to be followed during the evidentiary hearing and, IT IS ORDERED THAT:
1.
Unless the parties show good cause at the hearing to be held February 15, 1973, why other or different issues should be tried that the following will constitute the issues.
a.
The ultimate issue for determination is whether or not the activities under the license will create or maintain a situa-tion inconsistent with the antitrust laws.

Sub issues are:
1.
' hat is the structure of the Applicant including its ounership, relations to and arrangemants with othar utilities, its distribution systen, its capital and income and its sales policies at whole-sale and retail.
2.
What is the structure of the relevant market including the nature and extent of competition for electric power at whole-sale and retail, arrangements for coordi-nating and wheeling power and arrange-ments for and with customers'.
3.
What additional facts are necessary to understand the nature of the structure of Applicant and the relevant market including any facts demonstrating that the structure of Applicard: vas affected
, by activities tending to improperly increase its position in the market and including any facts deconstrating that the relevant market is improperly restricted, dominated or controlled by Applicant.
- 4. What will be the effect of the activi-ties of the plant proposed to be licensad on the strueture of the markee, and the position of Applicant in it.

Should the Board determine on the ultimate issue that the activities under the license r
will either create or maintain a situation inconsistent with ths antitrust laws, then it will determine frcm additional evidence to be offered thereafier whether the license should be suspended, denied or granted on l

- l condition, and in this connection will consider the need for pouar in the area and the effect of conditions proposed on the existing situation, or the situation to be created by activities under the license.

The Board at the February 15 hearing vill hear argument on the motion to eliminate certain issues and production of cer::ain documents by reason of the proceedings with regard to Duke Power Company before the Federal Power Commission and the rulings made therein.
