Dear Sir:
t Effective August 1,1977, the Commission's regulations contained in 10CFR Part 140 concerning indemnity fees were revised to re-ficct the reduction in the amount of Government indemnification and corresponding increases in financial protection to be main-tained by licensees as provided in the 1975 amendments to the Price-Anderson Act.
Invoices for indemnity fees issued since August 1, 1977 have reflected the reductions pursuant to the revised regulations.
For the period August 1, 1977 until the beginning of each subse-quent indemnity fee period, however, indemnity coverage was in effect at the previous existing fees. For Oconee Nuclear Station, the annual indemnity fee for each unit prior to August 1, 1977 was $77,040.
Since August 1, 1977, this fee has been $30,816.
Af ter August 1,1977, therefore an excess fee at an annual rate of $46,224 appears to have been paid. We believe that an adjust-ment (reimbursement, credit, etc.) should be forthcoming.

For each of the Oconee units the period during which the lower fee I
schedule was in effect but payment had been made on the prior fee schedule is as follows:
Oconee 1 August 1, 1977 - March 23, 1978 Oconee 2 August 1, 1977 - August 30, 1977 Oconee 3 August 1, 1977 - September 30, 1977.
