Dear Mr. Moseley,

With regard to the Oconee Nuclear Station security program, as of May 1, 1975 Duke Power Company is requiring all individuals, except NRC personnel, entering the station to execute a " Consent to be Searched, Detained, and Interrogated" statement. NRC personnel are currently exempted from this requirement as a result of discussions between Duke management personnel a: a NRC/0IE Region II on this matter. From these discussions it is und> atood that in accordance with the provisions of 10CFR 50.70, Inspect ..es, NRC/0IE Regioq II is of the position that there is a question as to the legality df requiring NRC employees to sign a consent statement as a condition for access to the station.

While the above concern is understood, it is felt that certain docu-mentation relating to this matter is necessary. Therefore, it is requested toa.. a statement be provided expressing the above position and expressing that in accordance with NRC and Oconee Nuclear Station security provisions that NRC employees and their possessions can be searched upon entry into and during their presence within the Oconee security area. It is also requested that NRC personnel who may be visiting Oconee and their applicable NRC security classification be identified and that such a listing be maintained current.
