California Indian Legal Services represented the Morongo Band of Mission Indians in connection with the California Energy Commission proceedings on the Sundeser Neclear Plant.
We are informed.that the Nuclear Regulatory Commission has, or will have, before it applications to construct or participate in Units 4 and 5 of the Palo Verde Nuclear Generating Station (PVNGS).
We are further informed that the constructicn of cr parti-cipation in these Units by Southern California Ediscn Co. (SCE) and San Diego Gas and Electric Co. (SCG&E) may necessitate cr be decendent upon contruction of One er T.cre 500 ':" transmissi:n lines was: frc= SCE's Devers'substati:n thrcugh the San 3crg:ni Pass.
Based upon the reccrd in the Sundesert prcceedings, it would seem tha; such construction could nc; cccur witho;; use of or impact upon the lands Of the Morong indian Reserva icn, which straddles the entire Pass area.
Under federal regulations, statutes and..other laws, the consent of the Morongo Band of In-dians to any-such use is a prerequisite to any such construction.
