UNION OF CONCERNED SCIENTISTS' REQUEST TO LATE FILE MOTION FOR RECONSIDERATION OF CLI-80-16 i 1

On May 16, 1980, the Commission issued CLI-80-16. A  ;

copy was received by Counsel for UCS on May 19. Assuming that the 10 day time limit of 10 CFR 52.771 for reconsidera-tion of final decisions applies, and accounting for the addi- l tional days permitted by 10 CFR S2.710, we calculate the deadline to have been Monday, June 2. This motion and the text of the Motion for Reconsideration are being hand-delivered l

to the Commission on Wednesday, June 4.

UCS states two basic reasons for requesting this additional time. First, Counsel for UCS has been heavily committed over the pertinent time period to other proceedings,

[ particularly the briefing before the Commission on May 29 I

dealing with seismic issues related to the Seabrook site. That i

! case required Counsel to become familiar with the complex l

actual record on an issue with which she had not previously been involved. Second (and related), the implications of the l

Commission's decision in CLI-80-16 did not become fully clear to UCS until we received on June 2, the Licensine; Board's memorandum and Order of May 30, 1980. It caused us to re-evaluate the need to move the Commission for recon-sideration of its decision.

For the above reasons, UCS requests permission to file its Motion for Reconsideration of CLI-80-16 two days late.
