Thank you for your. letter dated February 21, 1980, in response to our
' letter dated February ll, 1980 which requested fees for Classes IV and I
.pursuantsto 10 CFR 170.22 for your December 19, 1979 application for amendment to the construction permits'for Midland Unit Nos. 1 and 2.
You concluded-that since the amendment of December 19, 1979 resulted from'the December 6,.1979 Comission Order, no fees are due under the provision of Footnote 2 of Section 170.22.

Although the provisions of Footnote 2 to 10 CFR 170.22 exempt amendments resulting directly from orders issued by NRC pursuant to 10 CFR 2.204, it is not intended to exempt those applications for amendments resulting from non-compliance items noted during inspections.
On this basis, your December 19, 1979 application is not exempt from fees under Footnote 2 of be forwarded to this office within fifteen (quested sum of $12,700 should15) days 10_CFR 170;22. Therefore, the previously-re this letter.-
