- WASHINGTON, D. C. 20555 a
l March'4, 1980-MEMORANDUM FOR:
Denwood F. Ross, Acting Director
~ Division of Project Management, Office of j
Nuclear Reactor Regulation i
FROM:-
Edward S. Christenbury, Chief Hearing Counsel, Office of the Executiva Legal Director
~
SUBJECT:
Shearon Harris
~As you are no doubt aware the Appeal Board in ALAB-577. ordered the Staff to insure that no notice of opportunity-for hearing is issued on applications for operating licenses for the Shearon Harris units until:
(1) The Staff has made a preliminary evaluation on the basis of the applications and any other information it has, of CP&L's capability to manage the operation of these units in confonnity with all regulatory and other requirements.of the NRC; and
.(2) The Staff-has made that preliminary evaluation publicly available and brought it, with reference to the Licensing Board's and Appeal Board's decisions, to the attention of the Commission.
-Further, the notice of opportunity for hearing _is to indicate how this preliminary evaluation of the management capability can be obtained or examined.
The Appeal Board-made a point of noting that the preliminary review of CP&L's management capability should be "in depth" and consider I&E's experience with operations at Brunswick and Robinson.
c Although we have petitioned for review of this order, it is at present in effect.
-If you.wish any further guidance in this matter, do not hesitate to call
