Dear Mr. Hoffman:

RE: REQUEST FOR WITHHOLDING NUS DRAWING FROM PUBLIC DISCLOSURE By your application and affidavit dated October 25,.1979, and October 1, 1979, respectively, you submitted NUS Corporation Drawing 5148M2001 and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. This submittal is in reference to your letter dated October 1, 1979, which provided additional infonnation regarding the proposed expansion of the spent fuel storage capacity at Big Rock Point.

The reasons prvvided for our withholding of this drawing were that the infonnation contained in the drawing is considered to be proprietary by NUS becausa it contains design data and unique fabrication details which secure competitive economic advantage to'NUS by design. optimization and improved marketability, and includes information utilized by NUS in its business which affords NUS an opportunity to obtain a competitive advantage over its competitors who do not or may not know or use the information contained in the drawing. The affidavit also states that.the drawing provides information which reveals high density spent fuel rack design methods developed by NUS over the past several years, which is not available in public sources.

We have reviewed your application and material based on the requirements and criteria of 10 CFR 2.790 and have determined that the drawing described above contains proprietary connercial information.

We also have found at this time that the rightof the public to be fully

' apprised as to the bases for and effects-of the proposed action does not outweigh the demonstrated concern for protection of NUS' competitive position. ~~ccordingly, we have determined that the information should be withheld from public disclosure.

l We, therefore, approve your request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding NUS Drawing 5148M2001 from

public-inspection as proprietary. -Withholding from public inspection

- shall not affect the.right, if any, of persons properly and directly

-concerned to inspect the document.
