ORDER DENYING REQUISE AND DISMISSING PROTEST OF PIEIRONT ELECTRIC CITIIS On July 25, 1967, a group of cities and towns in North Carolina, which tem themselves the Piedmont Electric Cities and which consist of the Cities of Statesville, High Point, Lexington, Monrce, Shelby, and Albe=arle, and the Towns of Cornelius, Drexel, Granite Falls, Newton, and Lincolnton, filed with the Atomic Energy Cc=missicn a joint protest to the construction of the three nuclear plants pro-posed by the Duke Power Company in Ocenee County, South Carolina.

'Ihe protest includes a request that conditions be attached to any ecn-struction pemits that may be issued in the proceeding to provide for the purchase by the Piedmont Electric Cities of an undivided interest in the proposed nuclear plants scught to be ccnstructed and operated by Duke Power Ccmpany, to thus pemit the said Pied =cnt Electric Cities to share in the capacity hnd electric energy to be generated.

Piedmont also requested a hearing on this issue.

The protest, in addition, alleges mcnopolistic pracf,1ces by Duke Power Ccmpany in the sale of electricity and that any unconditional license issued by i

the Atcmic Energy Ccmmissica "... would appear to violate or tend toward the violation of Anti-Trust laws" and "... would appear to restrain free ccmpetition in private enterprise." The Piedmont Electric Cities also requested that Duke Power Ccmpany be required to " wheel" the electricity generated at the proposed nuclear plants to the Cities.

Duke Power Ccmpany filed an answer objecting to the requests and to the protest and asserted that the Atcmic Energy Ccmmission has not been authorized by the Atemic Energy Act, neither as origi-nally enacted nor as amended, to render determinaticus en such requests made by the Piedmont Cities, and that the said Act limits the Ccamission to a determinaticn of safety e.nd common defense and security issues.

hllEREFORE, upon a consideration of the requests and protest filed by the Piedmont Electric Cities, the objections by Duke Power Ccmpany and the Regulatory Staff of the Ccamissica and the Notice of Hearing issued by the Commissien,

- IT IS DETEB1INED that the requests and the protest of the listed Piedmont Electric Cities relate to and ccncern issues which cre not pertinent to and which are outside the jurisdiction of the Atcmic Energy Ccmmission and this Atomic Safety and Licensing Board, and therefore, IT IS ORDERED, pursuant to the Atcmic Energy Act, as amended,

' and the Rules and Regulations of the Ccamissicn that the requests of the Piedment Electric Citics are denied and their Protest to the construction proposed by Duke Power Company is dismissed.
