1. The reported groes alphe emissimo, everaged monthly, es given in the monitoring report covering the period October 1975 through Decenter 1978 (Outfall #001 - Sewer and Outf all #002 - Pond), ascend the *C 10 CFR 20 Appendix 3, Table II, Coluna 2 limiting welues for miatures of unknown radionuclides by 200 to 700 percent (that is, by factore bet.een two and seven). If one adds the two outfalle, se le logical because both ef fluents empty into the ases creek, then the grose alphe activity exceeds the NRC's lielting welues by 950% for October,197S3 7501 for hoveeers and 7D0% for Dec embe r.

Remembering the EPA calculation from the publication, " Environmental Analysis of the Urenium Fuel Cycle, Part 1 - Fuel Cycle," (EPA.520/9 003.B. published in 19733 page A-13), that en adult member of the public, drinking two liters of water per day with a concentration of one picoeurie per liter would receive a done of nine millireme per year, does that not moon that the levels indicated in the C:zabusticn Engineering monitoring reporte correspcsid to e dose of approximately three re me (3000 millirene) per year for en edult drinking two liters of Joachie Creek water per day in the isomediate vicinity, downstream from the plant? And what about the ef fect on the fisherven and their families who set the fish caught downstreen?

The limiting welues set by the State of Missouri in the current NPDES pemit are more abringent then those contained in the NRC regulations. For emewle, a limiting welue of the alphe-emitting Radium-226 of 30 picoeuries per liter is set by the NRC, while three picoeuries per liter is set by the WW.5 permit. I realire that the alphe-emitting radioactive meterials monitered by Ccubustion Engineering would not just consist of Radium-226, however the state does not give e limiting value for radioactive material of a mixture of unkncmen radionuclide concentratione. The NRC, as you know, uses the some limiting value of 30 picoeuries por liter for a mixture of unknowns as it does for Re-226.

2. The reported gross bote emissions, as everaged monthly for October, November and December, 1978, and reported by Comeustion Engineering, exceed the NRC's mesimum pemissible values for mined radionuclides by frne 200 to 14C05 (that is, by fectors between 2 and 14). If one adde the two outfalls, the grose bate emissions exceed the NRC permissible limite by 16004 for October,15001 for Novencer, and 57Dn for Deceeer.

The state limit for the betowmeitting Strontite-90 is tan picoeuries per liter, compared to which the reported everage groes bete activitie's per acsith at the Hematits plant eres

This corresponde to sucesses se great se 4000C above the state's NPDE5 limital Roughly the same levels of groes alphe activity given above were also reported to the Stato in 1976 for the second quarter (132 picoeuries per liter) and third quarter (168 41/1).

I would appreciate' it if you would let as know what the NRC hoe done about these excesolve levels of radioactivity, what you are going to do about thee, and why? What courses of action cre owsilable to the NRC or to anyone else to enforce those limitaticris or to seek genalties f;r violatione thereof? Thank you.
