Subject:

LICENSE AMEP:AENT FOR PROPOSED EXPORTS OF DISPERSED TRITIUM " ADDITIONAL DESTINATIONS (XB001141, AMENDMENT 01)

Purpose:

To obtain Commission views on the proposed amendment in accordance with the Commission's July 28, 1980 decision on delegations of authority.

Discussion:

On February 10, 1982, NRC staff issued license XB00ll41 to the U.S. Army Armament Materiel Readiness Command for the export of 64,000 curies of tritium incorporated in sealed light sources and assembled into optical instruments for ultimate use in weapons systems in Australia, Belgium, Japan, Jordan, Lebanon, Netherlands, Philippines, Thailand, Tunisia, and Portugal.

Each country will receive from 500 to 20,000 curies of dispersed tritium.

In addition to these countries, the licensee also requested permission to export the sealed light sources to Bahrain (2,000 curies), India (15,000 curies), Oman (3,000 curies),

Pakistan (8,000 curies), Saudi Arabia (3,000 curies), and Taiwan

-(9,000 curies) for the same end use (Appendix A). However, J

in accordance with the Commission's July 28, 1980 decision on delegations of authority, exports to these latter countries must be reviewed by the Commission.

In a letter dated February 3,1982 ( Appendix B), the State Department informed NRC that it is the view of the Executive 1

Discussion:

Atomic Energy Act of 1954, as amended, and would not be (Continued) inimical to the common defense and security of the United States, provided that only the export of tritium incorporated in luminous sources assembled in devices for weapons systems is authorized.

While the Executive Branch maintains strict controls over exports of bulk tritium gas, it maintains less stringent requirements for exports of tritium in dispersed form when it is incorporated in light sources for non-nuclear applications.

The staff notes that tritium, as a byproduct material, is subject only to the non-inimicality export licensing criterion.

In view of the non-nuclear end-use and the dispersed form of the tritium, the staff is in agreement with the Executive Branch that the proposed export to all of the requested destinations would not be inimical to the common defense and security of the United States.

In reaching this conclusion, the staff has eonsidered the special concerns related to approving exports m%so India and Pakistan at this time and believes that these concerns do not warrant denial of the export request for either of these two countries.

Recommendation:

That the Commission authorize the staff to amend XB00ll41 to allow the export of an additional quantity of 40,000 curies of dispersed tritium incorporated into sealed light sources assembled in devices for weapons systems to Bahrain, India, Oman, Pakistan, Saudi Arabia, and Taiwan.

Scheduling:

The applicant has advised that the components containing the tritium are integral parts of weapons systems which have previously been approved for export by the U.S. Government to Pakistan, Saudi Arabia, and Taiwan.

In order for the applicant to ship the systems to these three countries prior to March 31, 1982 to fulfill contractual obligations, Commission action is requested by March 15, 1982. With regard to the proposed exports to the remaining countrics--India, Bahrain, and Oman--no specific circumstance requires Commission action by a particular date.

Dear Mr. Shea:

I refer to the letter from your office dated December 7,1981, requesting Executive Branch views as to whether issuance of an export license in accordance with the application hereinafter described meets the applicable criteria in the Atomic Energy Act, as amended by the Nuclear Non-Proliferation Act of 1978:

NRC No. IB001141 - Application by Headquarters, U.S. Army Armament Materiel Readiness Command for authorization to export to various countries dispersed tritium in amounts of from 500 to 20,000 curies incorporated into sealed light sources and assembled in optical instruments for weapons systems.

Small amounts of promethium-147 are also to be supplied for the same purpose, but these exports may be pursuant to general license provisions covering byproduct material having an atomic number of 3 to 83.

It is the opinion of the Executive Branch that the proposed exports may be made without being subject to the terms of an Agreement for Cooperation since byproduct material may be licensed under Sections 81 and 82 of the Atomic Energy Act without the prerequisite of a Section 123 Agreement. The Executive Branch has concluded that this export is consistent with the provisions of the Atomic Energy Act of 1954, as amended by the Nuclear Non-Proliferation Act of 1978. Further,it is the judgment of the Executive Branch that the byproduct material exports contemplated will not be inimical to the common defense and security of the United States; provided that only the export of tritium incorporated in lumincus sources assembled into gun sights and other devices for weapons systems is authorized.

I On the basis of the foregoing, the Executive Branch recommends that the license be issued.
