Dear Mr. Reynolds:

This is in reply to your letter dated May 21, 1980, in which you requested, pursuant to the Freedom of Information Act, copies of documents prepared for compliance with the NRC's regulations 10 CFR, Part 73 concerning the physical protection of irradiated reactor fuel in transit.

You requested this information for the eight point-to-point routes specified in your letter.

In response 'to your request, we have identified the documents listed in Appendix A as being subject to your request. Also, some documents identified in two previous F0IA requests, F01A-79-471 (REYNOLDS) and F0IA-80-137 (HAMILTON /RESNIK0FF) are likewise subject to your request and files en these two requests are available for public inspection and copying in the NRC Public Document Room (PDR) located at 1717 H Street N.W., Washington, DC 20555. The charge for reproducing records located in the PDR is eight cents ($0.08) per page as specified in 10 CFR 9.14(a)

(copy enclosed), of the Commission's regulations.

Upon your agreement to pay the reproduction charges, the PDR will arrange for the records to be reproduced by Potomac Research, Inc., a private reproduction contractor servicing the PDR. You will be billed directly by Potomac Research, Inc. for the reprnduction charges plus tax and postage.

For your infonnation, a copy of the appeal letter in the matter of F01A-80-137 is enclosed in this letter to identify for you the NRC's action and policy in regard to requests for routes and other information on transporting irradiated reactor fuel, i

With respect to the documents listed in Appendix A, the information contained in these documents identifies the local and state. law enforcement assistance response capabilities, surfact transportation routes, and other information for safeguarding the licensed special nuclear material contained in the irradiated reactor fuel being transported. This information is considered commercial or financial (proprietary) information pursuant to 10 CFR 2.790(d) (copy enclosed) and is being withheld from public disclosure pursuant to Exemption (4) of the Freedom of Information Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) (copy enclosed) of the

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exenpt from production or disclosure, and that its production or disclosure is contrary to the

. public interest. The persons responsible for this denial are the undersigned and Mr. John G. Davis, Deputy Director, Office of Nuclear Material Safety and Safeguards.

This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
