On November 29, 1978, the Connission issued Construction Permits CPPR-172 & 173 to the Tennessee Valley Authority for the Yellow Creek Nuclear Plant, Units 1 &
4 2.
As required by 10 CFR 170.21, Tennessee Valley Authority paid an applica-tion fee of $125,000 when the application was filed in June 1976 and construc-tion permit fees totalling $1,016,100 ($853,600 for Unit 1 and $162,500 for Unit 2) at the time the construction permits were issued.
In accordance with Footnote 3 of Section 170.21, the costs incurred in the processing and issuance of the Yellow Creek 1 & 2 construction permits have been reviewed and they total $807,050 for Unit 1 and $45,519 for Unit 2.
Since
,the fees paid of $1,141,100 exceed the costs of processing and issuing the constuction permits, which total $852,569, a refund of $288,531 ($171,550 for Unit 1 and $116,981 for Unit ') is due Tennessee Valley Authority.
Consequently, we have concurrently authorized the Office of Controller to process the refund and to forward it to you as soon as possible.
