HOUSTON LIGHTING & POWER COMPANY REPORT ON STATUS OF SETTLEMENT By order dated April 10, 1980, the Atomic Safety and Licensing Board issued an order in this proceeding extending the dates for filing trial briefs and indefinitely postponing the dates for the final prehearing conference and the evidentiary hearing.

These dates were extended on the basis of a joint motion filed by the majority of the parties to the proceeding wherein it was represented that additional time was required in order to pursue settlement of this proceeding and related litigation.

In that order the Board also directed the parties to provide a written status report on the negotia-tions on or before May 9, 1980.

Since the issuance of the Board's order on April 10, substantial progress has been made in the settlement discus-sions.

On Friday, April 18, attorneys and officers from CSW, HL&P and TU met with representatives from the Department of Justice, the Nuclear Regulatory Commission, the Federal Energy Regulatory Commission, the Securities and Exchange Commission, and the Department of Energy for the purpose of explaining the content of the settlement among CSW, TU and HL&P.

It was explained that the settlement involved the construction of two direct current (DC) interconnections between the Electric Reliability Council of Texas and the Southwest Power Pool.

It was explained that the private parties had canvassed the electric utilities in Texas and the surrounding states to determine whether any other utilities desired to participate in the construction and ownership of these interconnection facilities and that the interconnections had been sized to accommodate the expression of interest

'i which had been received to date.

It was also explained that a formal invitation of participation would be made to all of the parties participating in the FERC proceeding and that the final determination as to the size of the interconnection would be based upon the responses received as a result of that formal invitation.

Engineering personnel from the three companies answered questions concerning various technical aspects of the interconnection as best they could considering the preli-minary engineering work that had been done as of that date.

. v Subsequent to the April 18 meeting, representatives of each of the three companies met individually with attorneys and consultants for the Department of Justice, NRC and FERC.

At these meetings the representatives for the government agencies explained the concerns they had with respect to the settlement and requested that the three companies respond with suggestions as to how to resolve those concerns.

The three companies subsequently responded to these concerns in writing and negotiations are still continuing with respect to those matters.

Houston believes that substantial progress has been made in the last month and that furt.:er postponement of the trial schedule is warranted.

Additional time is required for con-tinuance of the negotiations because of the complexity of the issues that are involved.

Houston believes that an additional extension of thirty days would be reasonable and appropriate.
