Inspection 50-29/80-05

This refers to the inspection conducted by Mr. W. W. Kinney of this office on

February 19-20, 1980 at the Yankee Nuclear Power Station, Rowe, Massachusetts of

activities authorized by NRC License No. DPR-3 and to the discussions of our

findings held by Mr. W. W. Kinney with Mr. N. N. St. Laurent of your staff at

the conclusion of the inspection, and to a subsequent telephone discussion

between Mr. St. Laurent and Mr. Kinney on March 10, 1980.

Areas examined during this inspection are described in the Office of Inspection

and Enforcement Inspection Report which is enclosed with this letter.

Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with personnel, and observations by the

inspector.

Within the scope of this inspection, no items of noncompliance were observed

even though a trailer containing low specific activity radioactive waste from

your facility had surface radiation readings greater than the 200 mR/hr limit

given in 49 CFR 173.393(j), when the trailer arrived at the Chem-Nuclear Systems,

Inc. , Barnwell, South Carolina burial site.

Your activities were in accord with

the pertinent regulations; however, you did make improvements in your procedures

for packaging the waste and in your specific instructions to carriers for maintenance

-

of the exclusive use shipment controls to maintain compliance with the requirements

of 49 CFR 173.393(j) during transport of the waste from your facility to the

burial site.

These improvements, if properly implemented, should avoid recurrence

of the situation.

Your strict attention to proper implementation of these

improvements are required to assure future compliance with the regulations.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title

10, Code of Federal Regulations, a copy of this letter and the enclosed inspection

report will be placed in the NRC's Public Document Room.

necessary that you make a written application within 20 days to this office to

withhold such information from public disclosure. Any such application must be

accompanied by an affidavit executed by the owner of the information, which

identifies the document or part sought to be withheld, and which contains a

statement of reasons which addresses with specificity the items which will be

considered by the Comission as listed in subparagraph (b) (4) of Section

2.790. The infonnation sought to be withheld shall be incorporated as far as

possible into a separate part of the affidavit.

If we do not hear from you in

this regard within the specified period, the report will be placed in the Public

Document Room.

No reply to this letter is required; however, should you have any questions

concerning this inspection, we will be pleased to ciscuss them with you.
