We have received a copy of your Proposed Change 168 (WYR 80-16) dated January 30, 1980, which was filed with the Office of Nuclear Reactor Regulation (0NRR) for review and approval. The proposed change is for modification of the Yankee-Rowe Technical Specifications specific surveillance requirements for the Emergency Boiler Feedwater System, in response to the ONRR staff's letter dated November 9, 1979.
Your Company concluded that this change is exempt from the fee requirements of 10 CFR 170 since it results from a written U.S. Nuclear Regulatory Commission (USNRC) request for an application to amend the Techni-cal Specifications.
When applications for license amendments or other approvals are requested ay the USNRC for the purpose of enhancing the safe operation of a nuclear facility or to correct a problem or potential problem area relating to operation (such as system reliability and performance and/or procedures), they are not exempt f.'om the fee requirements of 10 CFR 170.22, unless specifically ordered by the USMC pursuant to 10 CFR 2.204.
On this basis, licensees are required to pay fees for those Technical Specification changes requested by the USNRC in letters sent out during September through December 1979 relating to the acceptable performance of Auxiliary Feedwater Systems. Therefore, your Proposed Change 168 is not exempt from fees.
Based on guidance provided by the OdRR staff as a result of a preliminary review of your proposed change, it has been determined that the proposed action involves consideration of single safety issue. As such, it requires.a Class III fee of
$4,000 which should be forwarded to this office promptly.
If the final review of your proposed change by the ONRR staff reveals that this fee is incorrect, your Company will be refunded any overpayment or be asked to pay any additional amount due.
