License) i ORDER GRANTING STAFF'S MOTION TO COMPEL DISCOVERY (April 4, 1980) l On March 13, 1980, the NRC Staff, pursuant to 10 CFR 52.740(f),
filed a motion seeking an order compelling the Intervenor, Coulee Region Energy Coalition (CREC), to respond to the Staff's interrog-atories to CREC dated December 14, 1979. Neither CREC nor any other party has responded to this motion.
Our Order of November 30, 1979 established a schedule under which discovery requests were to be filed by January 15, 1980 and responses were to be filed by February 29, 1980.
The Staff's i
interrogatories to CREC were submitted well before the specified date, and apparently CREC has not responded to those interrogatories, despite the circumstance that it was afforded more time to do so than our November 30, 1979 order contemplated (and considerably more time than the minimum times specified by the NRC's discovery rules).

We agree with the Staff that answers to the questions it has asked are likely to assist it in preparing its testimony on i
the environmental issues admitted into contc,versy in this pro-ceeding.
A cursory examination of those questions indicates that, as the Staff claims, they are all directed either toward seeking clarification of the language of each of the admitted contentions or toward discovering the underlying basis for each i
contention.
To answer such questions, CREC need not undertake l
extensive research or data gathering.
It need answer only on the l
basis of information in its possession.
If it does not know an answer, it can so state.
And if it is in the process of develop-

t ing an answer, it can also so state.
Such answers (if true) are i
entirely acceptable, although they would be. subject to supplemen-l tation pursuant to 10 CFR 52.740(e).
Accordingly, the Staff's motion is granted.
CREC is directed to file answers to the Staff's interrogatories dated December 14, 1979 no later than April 25, 1980.
