INTERROGATORY 2 Please produce all documents relating to any joint actions, actual or contemplated, by three or more operating companies that are members of the Texas Interconnected System, or representatives of three or more operating companies that are members of the Texas Interconnected System, including, but not limited to, joint reports or studies, joint planning of generation or transmission expansion, and meetings of any kind.

I INTERROGATORY 10 Please produce all documents relating to purchase and/or sale of bulk power and/or energy by PSB.

SUPPLEMENTAL RESPONSE Documents relating to a proposed power sale by San Antonio to Houston Lighting and Power Company are attached hereto as Exhibit B.

INTERROGATORY 11 (b) Produce all documents relating to participation, actual or potential, by any electric utility in the South Texas Units, including the terms and conditions, limitations or restrictions of such participation.

(c) Identify all communications among officers, representatives or employees of PSB and all communications between any officer or representative of PSB and any other person, relating to participation in the South Texas Units by any other electric utility. Provide all documents relating to such communication.

SUPPLEMENTAL RESPONSE Documents constituting communications between San Antonio and the Brownsville PUB relating to participation by PUB in the South Texas Project are attached hereto as Exhibit C.

INTERROGATORY 17 Please produce rates of PSB for all classes of customers at all times since January 1, 1970.

SUPPLEMENTAL RESPONSE -

The gas and electric rate ordinance approved by the San Antonio City Council in July, 1979, together with the related rate schedules, is attached hereto as Exhibit D.

As we discussed, there are provisions in the South Texas Participation Agreement which will have to be given consideration. However, neither the Management Committee nor I as Chairman have the authority to agree to a sale of ownership interest of any or all of the South Texas Project participants. It would, therefore, be inappropriate for the Committee to consider your request, which should be addressed directly to the respective utilities for their individual consideration and decision.

As you are probably aware, t.he Public Utilities Board (PUB) of the City of Brownsville has been negotiating with Central Power and Light Company for the purchase of a share of CP&L's interest in the South Texas Project. We have re-quested that CP&L grant us the option to purchass up to ,

25 megawatts from both Unit 1 and 2.

Central Power and Light has informed PUB that they are willing to sell 12.5 megawatts and have suggested that we seek the remaining 37.5 megawatts of ownership from the three other partners.

In light of the foregoing, we are respectfully requesting that the participants sell Brownsville up to 50 megawatts in the proj ect. We are cognizant of the' constraints contained in the participation agreement and for this reason feel that this matter can be best addressed by your committee. I would appreciate your prompt consideration of this request.

This is in response to your letter of May 21, 1979, and attached resolution of March 28, 1979, concerning the purchase of base load electric generating capacity and potential ownbrship in existing power plants. I apologize for the delay in responding to your letter.

As you know, City Public Service has developed a diverse generation mix utilizing gas , oil and coal and is participating as a co-owner of the South Texas Project Nuclear Plant. This construction planning has been based on serving the growing public utility elec-trical needs of our customers with an acceptable degree of reliability

' ncluding, i in the case of the South Texas Project, joint planning and discussions with other electric utility systems in our part of the State prior to obtaining construction permits.

In light of the projected capacity needs of our own cystem, it does not appear at the present tbne that the sale of any ownership interest in our existing coal plant or nuclear generating units under construction would be in the best interests of City Public Service customers. We are interested, however, in discussing further a sale to the Public Utilities Board of power and energy at the rate of approximately 50 megawatts.

Additionally, we suggest the scheduling of joint planning meetings be-tween our engineering staffs to study the feasibility of possible future shared generating capacity existing or planned. Please let us know if you need further information on this or any related matter.
