B.
10 CFR 50, Appendix B, Criterion VII states, in part, that " measures shall be established to assure that purchased material... conform to procurement requirements." The NFS " Operations Manual for Quality Assurance" developed pursuant to 10 CFR 50.34(b)(6)(ii) and 10 CFR 50, Appendix B, requires in paragraph 1.1.2 " Organization" that the Quality Assurance Supervisor verify the conformance of materials, items or systems with the specifications, material certifications...on safety related items. Specifications for purchasing HEPA filters attached to purchase order number WV46149 dated September 25, 1979, required the manufacturer to certify in writing that filters comply with the latest issue of Military Specification F-51068.
Centrary to the above, as of January 10, 1980, the Quality Assurance Suparvisor had not verified the conformance of HEPA filters, received on or about October 10, 1979, with the purchase documents in that the manufacturer had not included a certification in writing, with the shipment, that the filters comply with the latest issue of Military Specification F-51068.
