This is in response to your letter dated March 3,1980, in which you requested an exemption from the requirement found in 10 CFR 70.58(e) to perform a receivers measurement on certain fuel rods containing special nuclear material.
We have reviewed your proposed procedures and have found them acceptable provided that the receiver of the sectioned fuel rods will accept the fabricators' values for the quantity of contained special nuclear.raaterial.
We have also detennined that the granting of your request will not adversely affect the comon defense and security, and is otherwise in the public interest.
Therefore, a new license condition 2.7.2 is hereby added, effective immediately, to Amendment MPP-2 to your license SNM-1227.
2.7.2 Notwithstanding the requirements of 10 CFR 70.58(e) to measure all special nuclear material received or shipped, the licensee.shall be permitted to section, package, and ship certain special nuclear material described in his letter dated March 3,1980, provided that the receiver will accept the fabricators measured values, and that two man surveillance will be followed whenever the SNM is accessible.
In the event that the receiver does not accept the fabricators' 4
values for the SNM content, the licensee shall perform or have performed independent measurements on the referenced fuel as required by NRC regulations.
It has been established that your letter dated March 3,1980, contains information of a type specified in 10 CFR 2.790(d). Accordingly, they are deemed to be commercial or financial infonnation within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
