APPENDIX A NOTICE OF VIOLATION National Bureau of Standards Docket No. 50-184 Based on the results of an NRC inspection conducted on August 28-31, September 1, 4 and 5, and October 23-26, 1979, it appears that one of your activities was not conducted in full compliance with NRC regulations as indicated below. This item is an infraction.

10 CFR 20.201, " Surveys," defines a " survey" as an evaluation of the radiation hazards incident to the production, use, release, disposal, or presence of radioactive materials or other sources of radiation under a specific set of conditions.

10 CFR 20.201(b) requires each licensee to make or cause to be made such surveys as may be necessary for him to comply with the regulations in this part.

10 CFR 20.301 " Waste Disposal - General Requirements" specifies that no individual shall dispose of licensed material except by transfer to authorized individuals as provided in the regulations in Part 30, 40 or 70 of this chapter.

Additionally,10 CFR 20.301 provides for disposal by burial in soil or release to sewerage systems provided the regulatory requirements referenced in 20.301 with respect to the above are adhered to.

Included in the above references are limits provided in 10 CFR 20.106, Radioactivity in Effluents to Unrestricted Areas.

Contrary to the above, as of August 28, 1979, surveys necessary to assure compliance with the regulatory requirements of 10 CFR 20.301, were not performed in conjunction with a heat exchanger temporarily disposed of by the licensee via storage, in that radioactive materials leaking from the waste heat exchanger were released to unrestricted areas and surveys neces-sary to be made by the licensee to assure compliance with 20.301 were not performed since disposal of the heat exchanger in 1974.

10 CFR 20.203 " Caution signs, labels, signals and controls," specifies that each area or room containing any radioactive material in any amount exceeding 10 times the quantity of such material specified in Appendix C shall be posted " Caution Radioactive Materials."

s Contrary to the above, as of August 28, 1979, surveys, necessary to assure the posting requirements of 10 CFR 20.203'were met, were not made for six Radioactive Materials areas containing 10 times the amount of such material specified in Appendix C located around and outside the licensee's Reactor Building since 1974.
