Dear Senator Mathias:

I am writing in response to your letter of February 20, 1980, for infor-mation to respond to a letter to you from Mr. and Mrs. Bogardus of February 9, 1980.

Concerning the restart of Three Mile Island, Unit 1 (TMI-1), on July 2,1979, the Comission ordered that TMI-1 remain in a cold shutdown condition until further order by the Comission and stated that a public hearing would be held prior to restart of THI-1. The Comission believes that public participation is a vital ingredient in matters related to TMI-1 restart plans.

On August 9,1979, the Comission issued an additional Order on TMI-1 speci-fying the basis for the Shutdown Order and the procedures to govern the hearing regarding restart. On the basis of this hearing, the Comission will determine whether any further operation of TMI-1 will be permitted and, if so, under what conditions.

I have enclosed a copy of the August 9,1979, Order for your information.

The Comission carefully considered the time required for completing all tasks related to the Order. The Comission requested that the hearing be conducted expeditiously within the bounds that the hearing be fair and thorough. A tentative schedule, suggested by the Comission, calling for expeditious handling of the necessary NRC staff and procedural. actions required for the hearing process is provided on the last page of the Comission's Order.

Because of the scope of the proceeding, the magnitude of intervention, and late submission of technical material from the licensee, it does not appear that the hearing will begin before late June,1980. On this basis, restart of TMI-1 could not be expected before the end of 1980.

I trust that this information permits an adequate response for your constit-uents' inquiry.
