Dear Mr. O' Leary:

This is to respond to your letter of September 21, 1972.

In this letter, you summarized the AEC position with respect to three safety issues having the potential to cause delays in the current schedule for bringing Crystal River Unit #3 to the commercial operation stage.

These safety issues are steam system design, plant protection against flooding, and augmented staffing during plant start-up.

You requested that we advise you of the course of action that we intend to pursue with regard to each of the issues identified above.

The fo! lowing represents our position on each of these issues and our intended course of action.

1.

Steam System Design - Plant Protection Against Flooding The AEC concerns in these two areas were contained in the Request For Additional Information, Florida Power Corporation, Crystal River Unit #3, Docket No. 50-302 attached to the letter from R.C. DeYoung of July 24, 1972.

We indicated in a letter of August 4, 1972, to Mr. DeYoung that October 16, 1972, was the earliest possible date that we could supply the requested infonnation.

We currently have scheduled a meeting with AEC personrel for October 27, 1972, to discuss the plant protection against flooding issue.

It is felt that this meeting is necessary and-will provide guidance to us in formulating the proper responses to your Request For Additional Information. As a result of the above, we request that our response to the AEC concerns be deferred until after the October 27 meeting. We will be able to assess at that time our position, having the benefit of the AEC guidance and direction, au can respond shortly thereafter in a responsible manner.

Augmented Staffing During Plant Start-Up We agree with the AEC comments on this issue contained in your September 21, 1972, letter. We are confident that sufficient personnel with sufficient experience will be available during the start-up and power ascension testing period for Crystal River 5645 A

Mr. John F. O' Leary October 9, 1972 Unit #3. We do not consider this issue to be one having the i

potential to cause delay in the completion of Crystal River Unit #3 at this time. The information needed by the AEC to adequately assess the capability of our staff, and augmenting personnel, to successfully and safely test and operate Crystal River Unit #3 is contained within Sections 12 and 13 of the Final Safety Analysis Report, Conduct of Operations and Initial Tests and Operation respectively.

These sections are currently being updated in order to present to the AEC up-to-date information and to adequately convey in a clear fashion the staff capabilities and organization which will be utilized.

In a letter of July 7,1972, from Mr. R.C. DeYoung, we were informed that the AEC was postponing for approximately ten months the review of our Final Safety Analysis Report, with the exception of the two issues discussed in 1. above.

In line with this postponement, and recognizing that personnel training and replacement is an ongoing process, we decided not to submit the updated versions of Sections 12 and 13 until a later date which would be prior to the AEC resumption of its review.

This would allow more current information to be available at that time.

Therefore, we do not intend to submit this information to the AEC at this time.

If this is not agreeable to you, please advise and we will respond accordingly.

If the above information and discussion needs further clarifica-tion, please do not hesitate to contact us. We are convinced that joint cooperation between the AEC and ourselves will lead to the resolution of the remaining safety issues and the successful completion of Crystal River Unit #3.
