Dear Mr. Giambusso:

In late 1973, the Regulatory Staff expressed in WASH-1270 a detailed licensing position on Anticipated Transients Without Scram Analysis (ATWS), which established present and future guidelines for nuclear power plant licensing.

In response to the WASH-1270 licensing position, Babock & Wilcox submitted to the Directorate of Licensing (DOL) topical report BAW-10099, " Babcock & Wilcox Anticipated Transients Without Scram Analysis", dated December,1974. The results of this topical report adequately represent Crystal River Unit No. 3 and are intended to supplement BAW 10016, " Analysis nf Anticipated Transients Without Trip",

dated September,1972, which is currently on file with the Commission.

Considering in total the inherent p1' ant features, the time when the

' plant was designed, and the low probability of occurrence for ATWS events, we have concluded that hardware modifications at Crystal River Unit No. 3 are not required for ATWS considerations.

Topical Report BAW 10099 will be adopted as part of our application via of Amendment No. 44 to the Crystal River Unit No. 3 FSAR, which will be filed with the Commission on February 4, 1975.
