Dear Mr. Muller:
Thank you for your comments of January 12, 1976, on the National Pollutant Discharge Elimination System (NPDES) permit for the above referenced facility.
This letter is in response to those comments.
1.
Thermal limits - the permit has been revised to reflect the At requirements of the ETS.
2.
Chlorination - the suggestion that chlorination be conducted during off-peak hours has been deleted.
3.
Percolation pond monitoring - under current interpre-tation of EPA regulations no authority is given to include ground water regulation and monitoring in NPDES permits.
4.
Page 3, A, cooling water discharges - this has been changed to "once-through equipment cooling water."

The thermal comporant of this discharge is subject to effluent limitations which consist of off-stream cooline pursuant to Section 301 of the Act. However, the permittee may request a hearing in conformance with the provisions of Section 316(a) of the Act,at anytime prior to June 30, 1978.
If at said t earing the permittee can demonstrate that discharge of once-through '
cooling water through the mc di fied discharge canal (See Par,t lilE) will not cause substantial damage to a balanced indigerous population of shellfish, fish, and wildlife in and on the receiving body of water, th( requirements of Section 316(a) thall be satisfied and off-stream ccoling will not le a requiiement of this permit.

Permittee shall make the fo'llowing modifications to facility intake ~and
- discharge canals no.later than December 3.1, 1976:
(1) Extend the south' dike of.the discharge canal approxiinately '1615 -
meters (5300 feet) seaward.
(2)
Construct a parallel dike along the north side of.the discharge canal approximately 3597 maters (11800 feet) seaward.
(3) Extend the 3 meter (10 feet) depth of the discharge canal seaward approximately 1615 meters (5303 feet).
1 (4) Extend the south side of the intake canal approximately 2316 meters (7600 feet) seaward.
(5)
Deepen the extended intake canal to an average depth of approximately 6 meters (20 feet).
Approval for construction necessary for these modifications shall be obtained prior to construction in accordance with State and Federal laws and regulations.
F.
No later than three (3) months af ter completion of the intake canal modifications outlined in lilE above and start-up of generating Unit Number 3, permittee shall imple. ment an approved 316(b)' study to evaluate the effects of the cooling water intake relative to impingement and entrainment.
Results of this study shall be reported to the Regional Administrator and State Director no later than eighteen (18) months after implementatinn.
Based on this study, the Regional Administrator shall make a determination as to the possible need for procedure modification, facility construction, or of f-stream cooling. Ninety (90) days af ter o'pportunity for hearing and review, perraittee shall submit for approval an implementation schedule for construction of such facilities as the determination shall find necessary.
G.
No later than three (3) months af ter completion of the intake canal modifications outlined in fart lilE above and start-up of generating Unit Number 3, permittee shall impler..:nt an approved 316(a) study designed to evaluate the effect of the thermal discharge from the modified discharge canal (Sce Part tile) on the inc'igenous population of. shellfish, fish, and wildlife in and on the receiving body of water.
Results of this study

shall be reported to the Region.1 Administrator and State Director no later than eighteen (18) conths after implementation.
In the event permittee falls to submit the above-mentioned study plan by the Indicated clate, the Regionai Administrator shall make a determination based on the data available. Within ninety (90) days of-notification of this determination, permittee shall submit an implementation schedule for the construction of off-stream cooling or other facilities as the determination shall require. Upon approval of the implementation schedule, the permittee shall expeditiously undertake. construction in-accordance m q"
